" وَإِلَّا " بِأَنْ كَانَ فِي الذِّمَّةِ " طَالَبَهُ " بِهِ " إنْ لَمْ يَعْتَرِفْ بِوَكَالَتِهِ " بِأَنْ أَنْكَرَهَا أَوْ قَالَ لَا أَعْرِفُهَا " وَإِلَّا " بِأَنْ اعْتَرَفَ بِهَا " طَالَبَ كُلًّا " مِنْهُمَا بِهِ " وَالْوَكِيلُ كَضَامِنٍ " وَالْمُوَكِّلُ كَأَصِيلٍ فَإِذَا غَرِمَ رَجَعَ بِمَا غَرِمَهُ عَلَى الموكل
