" فَإِنْ كَانَتْ " قِيمَتُهُ وَقْتَ تَلَفِهِ " دُونَ أَقْصَى قِيَمِهِ حَلَفَ " وُجُوبًا " لِلزَّائِدِ " أنه يستحقه لأن عريمه يُنْكِرُهُ وَيَحْلِفُ لِلْأُجْرَةِ مُطْلَقًا إنْ مَضَتْ مُدَّةٌ لها أجرة.
