" فَإِنْ جُهِلَ " مَالِكُهُ " وَالْعِمَارَةُ إسْلَامِيَّةٌ فَمَالٌ ضَائِعٌ " الْأَمْرُ فِيهِ إلَى رَأْيِ الْإِمَامِ فِي حِفْظِهِ أَوْ بَيْعِهِ وَحِفْظِ ثَمَنِهِ أَوْ اقْتِرَاضِهِ عَلَى بَيْتِ الْمَالِ إلَى ظُهُورِ مَالِكِهِ " أَوْ جاهلية فيملك بإحياء " كالركاز نعم إن كَانَ بِبِلَادِهِمْ وَذَبُّونَا عَنْهُ وَقَدْ صُولِحُوا عَلَى أَنَّهُ لَهُمْ فَظَاهِرٌ أَنَّا لَا نَمْلِكُهُ بِإِحْيَاءٍ
