" فَلَوْ لَقَطَهُ غَيْرُهُ " مِمَّنْ بِهِ رِقٌّ وَلَوْ مُكَاتَبًا أَوْ كُفْرٌ أَوْ صِبًا أَوْ جُنُونٌ أَوْ فِسْقٌ أَوْ سَفَهٌ " لَمْ يَصِحَّ " فَيُنْزَعُ اللَّقِيطُ مِنْهُ لِأَنَّ حَقَّ الْحَضَانَةِ وَلَايَةٌ وَلَيْسَ مِنْ أَهْلِهَا " لَكِنْ لِكَافِرٍ لَقْطُ كَافِرٍ " لِمَا بَيْنَهُمَا مِنْ الْمُوَالَاةِ
