" وَلَوْ ازْدَحَمَ أَهْلَانِ " لِلَقْطٍ عَلَى لَقِيطٍ " قَبْلَ أَخْذِهِ " بِأَنْ قَالَ كُلٌّ مِنْهُمَا أَنَا آخُذُهُ " عين الحاكم من يراه " ولومن غَيْرِهِمَا إذْ لَا حَقَّ لِوَاحِدٍ مِنْهُمَا قَبْلَ أَخْذِهِ " أَوْ بَعْدَهُ " أَيْ بَعْدَ أَخْذِهِ " قُدِّمَ سابق " لسبقه باللقط لا يَثْبُتُ السَّبَقُ بِالْوُقُوفِ عَلَى رَأْسِهِ بِغَيْرِ أَخْذِهِ
