" وَإِنْ فَارَقَ وَعَلَيْهِ ثَمَرٌ مُؤَبَّرٌ " بِأَنْ تَشَقَّقَ طَلْعَهُ " لَمْ يَلْزَمْهَا قَطْعُهُ " لِيَرْجِعَ هُوَ إلَى نِصْفِ النَّخْلِ لأنه حدث في ملكها فَتُمَكَّنُ مِنْ إبْقَائِهِ إلَى الْجِذَاذِ.
