" وحرم " عله "تَمَتُّعٌ بِهَا " أَيْ بِالرَّجْعِيَّةِ بِوَطْءٍ وَغَيْرِهِ لِأَنَّهَا مُفَارِقَةٌ كَالْبَائِنِ " وَعُزِّرَ مُعْتَقِدُ تَحْرِيمِهِ " لِإِقْدَامِهِ عَلَى مَعْصِيَةٍ عِنْدَهُ فَلَا حَدَّ عَلَيْهِ بِوَطْءٍ لِشُبْهَةِ اخْتِلَافِ الْعُلَمَاءِ فِي حُصُولِ الرَّجْعَةِ بِهِ وَذِكْرُ التَّعْزِيرِ فِي غَيْرِ الْوَطْءِ مِنْ زِيَادَتِي هُنَا
