" فَإِنْ لَمْ يَظْهَرْ أَثَرٌ وَمَاتَ حَالًا فَشِبْهُ عَمْدٍ " لِأَنَّ مِثْلَهُ لَا يقتل غالبا واقتصاري عَلَى التَّأَلُّمِ كَافٍ كَمَا صَحَّحَهُ النَّوَوِيُّ فِي شَرْحِ الْوَسِيطِ فَلَا حَاجَةَ لِذِكْرِ التَّوَرُّمِ مَعَهُ كَمَا فَعَلَهُ فِي الْأَصْلِ
