وَمَنْ لَهُ قَوَدُ نَفْسٍ بِسِرَايَةِ طَرَفٍ فَعَفَا عَنْهَا فَلَا قَطْعَ أَوْ عَنْ الطَّرَفِ فَلَهُ حَزُّ الرَّقَبَةِ

" وَمَنْ لَهُ قَوَدُ نَفْسٍ بِسِرَايَةِ " قَطْعِ " طَرَفٍ فَعَفَا عَنْهَا فَلَا قَطْعَ " لَهُ لِأَنَّ مُسْتَحَقَّهُ الْقَتْلُ وَالْقَطْعُ طَرِيقُهُ وَقَدْ عَفَا عَنْ مُسْتَحَقِّهِ وَقَالَ الْبُلْقِينِيُّ الْمُعْتَمَدُ أَنَّ لَهُ الْقَطْعَ وَصَرَّحَ بِهِ فِي الْبَسِيطِ " أَوْ " عَفَا " عَنْ الطَّرَفِ فَلَهُ حَزُّ الرَّقَبَةِ " لِاسْتِحْقَاقِهِ لَهُ.
