" فعليه دية " لورثة الجاني لأنه بان أن قَتَلَهُ بِغَيْرِ حَقٍّ فَعُلِمَ أَنَّهُ لَا قَوَدَ عليه لِعُذْرِهِ وَلَا دِيَةَ عَلَى عَاقِلَتِهِ " وَلَا يَرْجِعُ بِهَا " عَلَى عَافٍ لِأَنَّهُ مُحْسِنٌ بِالْعَفْوِ
