" وَلَوْ هَرَبَ " الْجَانِي " أَوْ مَاتَ بَرِئَ سَيِّدُهُ " مِنْ عُلْقَتِهِ " إلَّا أَنْ طَلَبَ " مِنْهُ " فَمَنَعَهُ " فَيَصِيرُ مُخْتَارًا لِفِدَائِهِ فَالْمُسْتَثْنَى مِنْهُ صَادِقٌ بِأَنْ لَمْ يَطْلُبْ مِنْهُ أَوْ طَلَبَ وَلَمْ يَمْنَعْهُ
