" وَلَوْ عَفَا وَلِيُّهُ " أَيْ الْقَتِيلِ " بِمَالٍ وَجَبَ " الْمَالُ " وَقُتِلَ " الْقَاتِل " حَدًّا " لِتَحَتُّمِ قَتْلِهِ " وَتُرَاعَى الْمُمَاثَلَةُ " فِيمَا قُتِلَ بِهِ كَمَا مَرَّ بَيَانُهَا فِي فَصْلِ الْقَوَدِ لِلْوَرَثَةِ
