" وَلَا يَنْعَزِلُ قَبْلَ بُلُوغِهِ عَزْلُهُ " لِعِظَمِ الضَّرَرِ بِنَقْضِ الْأَحْكَامِ وَفَسَادِ التَّصَرُّفَاتِ نَعَمْ لَوْ عَلِمَ الْخَصْمُ أَنَّهُ مَعْزُولٌ لَمْ يَنْفُذْ حُكْمُهُ لَهُ لِعِلْمِهِ أَنَّهُ غير حاكم باطنا ذكره الماوردي.
