" وَإِنْ لَمْ يَثْبُتْ " ذَلِكَ وَبَيَّنَ الْمُدَّعِي قَدْرَ مَا ادَّعَاهُ " فَلَهُ تَحْلِيفُ شَرِيكِهِ " كَنَظَائِرِهِ وَلَا يَحْلِفُ الْقَاسِمُ الَّذِي نَصَبَهُ الْحَاكِمُ كَمَا لَا يَحْلِفُ الْحَاكِمُ أَنَّهُ لَمْ يَظْلِمْ
