بِخِلَافِ الْمَوْتِ لِأَنَّ الذِّمَّةَ خَرِبَتْ بِالْمَوْتِ دُونَ الْحَجْرِ " وَبِهِ " أَيْ وَبِالْحَجْرِ عَلَيْهِ بِطَلَبٍ أَوْ بِدُونِهِ " يَتَعَلَّقُ حَقُّ الْغُرَمَاءِ بِمَالِهِ " كَالرَّهْنِ عَيْنًا كَانَ أَوْ دَيْنًا أَوْ مَنْفَعَةً فَلَا تُزَاحِمُهُمْ فِيهِ الدُّيُونُ الْحَادِثَةُ
