(ومن اشترى شجرة) أو نخلة فأكثر ولم يتبعها ارضها (ولم يشترط قطعها قله) أى مشتريها (إبقاؤها في أرض بائعـ) ـها بلا أجرة كثمر على شجر (و) له (الدخول لمصالحها) لا لتفرج ونحوه، و (لا) يملك (غرس مكانها) إذا بادت لأنه لا يملكه (فصل. ولا يصح بيع ثمر قبل بدو صلاحه، ولا) بيع
