(و) لمرتهن أن (ينتفع بغيرهما) أى غير المركوب والمحلوب كثوب (بالإذن) من مالكه مجانا ولو بمحاباة (ما لم يكن الدين قرضاً) فيحرم لجره النفع لكن يصير مضموناً بالانتفاع،
