(وإن تسلم عينا بـ) إجارة (فاسدة وفرغت المدة لزمه أجرة مثلها) لبقائها في يده في تلك المدة سكن أو لم يسكن لأن المنفعة تلفت تحت يده بعوض لم يسلم للمؤجر فرجع إلى قيمتها،
