(قَوْلُهُ كَمَا مَرَّ) أَيْ فِي الْبَابِ السَّابِقِ فِي قَوْلِهِ: وَالْمُحَكَّمُ كَالْقَاضِي، وَأَفَادَ جَوَازَ تَحْكِيمِ الْمَرْأَةِ وَالْفَاسِقِ لِصَلَاحِيَّتِهِمَا لِلْقَضَاءِ وَالْأَوْلَى أَنْ لَا يُحَكِّمَا فَاسِقًا بَحْرٌ.
