(وَلَا يَصِحُّ تَوْكِيلُ عَبْدٍ مَحْجُورٍ وَصَحَّ لَوْ مَأْذُونًا أَوْ مُكَاتَبًا، وَتَوَقَّفَ تَوْكِيلُ مُرْتَدٍّ، فَإِنْ أَسْلَمَ نَفَذَ، وَإِنْ مَاتَ أَوْ لَحِقَ أَوْ قُتِلَ لَا) .
