(قَوْلُهُ وَلَا يَحْلِفُ) ضَبَطَهَا الْمُؤَلِّفُ - رَحِمَهُ اللَّهُ - بِتَشْدِيدِ اللَّامِ.

(قَوْلُهُ لِأَنَّهُ أَسْقَطَ حَقَّهُ) أَيْ حَقَّهُ فِي الْخُصُومَةِ، وَاَلَّذِي فِي الْبَحْرِ لِأَنَّهُ أَسْقَطَ خُصُومَتَهُ بِأَخْذِ الْمَالِ مِنْهُ مَدَنِيٌّ.
