مسألة: (وإنِ اقْتَصَّ مِن سِنٍّ فعادَتْ، غَرِمَ سِنَّ الجانِى) لأنَّه قد تَبَيَّنَ أنَّ القِصاصَ لم يَكُنْ يجبُ، ويَضْمَنُها بِالدِّيَةِ دُونَ القِصاصِ؛ لأنَّه لم يَقْصِدِ التَّعَدِّىَ
