وَلَا وَجْهَ لَهُ، وَعَنْهُ: لَا يَبْلُغُ بِهِ الْحَدَّ، جَزَمَ بِهِ الْخِرَقِيُّ، وَقَدَّمَهُ فِي الْمُذْهَبِ وَالْمُحَرَّرِ، فَيُحْتَمَلُ أَنَّهُ أَدْنَى حَدٍّ مَشْرُوعٍ، وَهُوَ قَوْلُ الْأَكْثَرِ، وَيُحْتَمَلُ أَنْ لَا يَبْلُغَ بِكُلِّ جِنَايَةٍ حَدًّا مَشْرُوعًا فِي جِنْسِهَا،
