[ذكر الفلو يتبع الدابة] واختلفوا في الفلو يتبع الدابة التي عليها صاحبها. فقالت طائفة: يضمن الراكب. هذا قول النخعي، والحكم، وحماد. وقال الشعبي (١): كل مرسلة فصاحبها ضامن. وفيه قول ثان: قاله الحسن البصري قال: لا يضمن.
