مسألة: الضمان لا يبرئ ذمة المضمون منه خلافا لابن أبي ليلى وداود؛ لقوله صلى الله عليه وسلم: «نفس المؤمن مرتهنة بدينه حتى يقضى عنه» وقوله لأبي قتادة: «الآن بردت عليه جلده» ولأنه وثيقة بالحق كالرهن والإشهاد.
