مسألة: يصح الخلع من الأجنبي للزوج، خلافا لأبي ثور؛ لأن الأجنبي من أهل المعاوضات يصح منه البدل في غير الخلع، فصح في الخلع كالزوجة ولأنه لما كان للزوج أن يطلق بغير شيء كان له أن يطلق بعوض على أجنبي كالخلع.
