مسألة: إذا قال له يا لوطي فعليه الحد، وقال أبو حنيفة: لا حد عليه وبناه على أن اللواط لا يجب به حد؛ فدليلنا أنه رماه بفاحشة موجبة للحد والغسل فكان به قاذفا كالزنا، ولأنه رماه بوطء آدمي لا تصح استباحته إياه بوجه، فأشبه أن يرميه بوطء ذات محرم منه.
