مسألة: ومن ادعى أنه تزوج امرأة تزويجا صحيحا سمعت دعواه، ولم يكلف أن يذكر شروط الصحة، لأنها دعوى عقد صحيح فوجب استماعها كما لو ذكر شروط الصحة، لأنها عقد معاوضة فوجب أن تسمع الدعوى فيه على الصحة بجملة من غير اعتبار ذكر شرائط الصحة، أصله البيع.
