مسألة: يجوز مكاتبة العبد القن الذي هو غير مكتسب، ويكره في الأمة إذا لم تكن مكتسبة، خلافا للشافعي في قوله: لا يكره؛ لما روي عن عثمان رضي الله عنه أنه قال: لا تكلفوا الأمة الكسب، فإنها تكسب بفرجها، روي ذلك مرفوعا.
