مسألة: ليس من شرط الأذان الطهارة خلافا لإسحاق إن صح عنه لقوله - صلى الله عليه وسلم -: (إذا حضرت الصلاة فأذنا وأقيما) . ولم يشترط الطهارة ولأنه ذكر في غير الصلاة كالدعاء ولأن قراءة القرآن أفضل من الأذان، ثم هي جائزة مع الحدث، والأذان أولى، ولأن المقصود منه الإعلام بالصلاة وذلك يحصل مع الحدث كمن هو من أهله.
