مسألة: إذا أوصى له بأبيه أو بابنه فأبى أن يقبله لم يلزمه قبوله، وحكي عن قوم أنهم أوجبوا عليه قبوله؛ فدليلنا أنها وصية فلم يلزم قبولها كالوصية بالمال، ولأنه استجلاب مال فلم يجب، أصله الابتياع.
