مسألة: يجب على الرجل إخراجها عن عبده وولده الصغير الذي لا مال له. خلافا لداود؛ لقوله - عليه السلام -: (أدوا عمن تمونون) ، وروي عنه عليه السلام: (عفوت لكم عن صدقة الخيل، والرقيق، إلا صدقة الفطر في الرقيق) ؛ ولأنها طهارة تجري مجرى المؤونة كالنفقة.
