مسألة: لا يصح الصيام إلا بنية. خلافا لزفر في قوله: إن صوم رمضان يصح بغير نية، لقوله عليه السلام: (لا صيام لمن لم يبيت الصيام من الليل) ؛ ولأنه صوم شرعي، فأشبه ما عدا رمضان؛ ولأنه نوع من الصيام كالنذر والنفل.
