مسألة: إذا ثبت أنه محرم فقال مالك لا جزاء عليه، وقال ابن أبي ذئب، فيه الجزاء. فوجه قول مالك أن كل بقعة جاز دخولها بغير إحرام لم يضمن صيدها بالجزاء، أصله سائر البلاد. ووجه قول إيجاب الجزاء؛ لأنه حرم يحرم صيده فضمن بالجزاء كمكة. [تفضيل المدينة على مكة]
