مسألة: إذا تراضيا على أن يكون الرهن في يد عدل جاز خلافا لابن أبي المطلب وداود؛ لأن الرهن حصل مقبوضا عن الراهن في يد من يقوم مقام المرتهن فصح ذلك كما لو كان في يد المرتهن.
