مَنْ يَتَحَمَّل الدِّيَةَ مِنْ ذَوِي الْقَرَابَةِ: ١٥ - اتَّفَقَ الْعُلَمَاءُ عَلَى أَنَّ مَنْ يَتَحَمَّل الدِّيَةَ مِنْ ذَوِي الْقَرَابَةِ هُمُ الْعَاقِلَةُ، كَمَا اتَّفَقُوا عَلَى أَنَّ الزَّوْجَيْنِ لاَ يَدْخُلاَنِ فِي الْعَصَبَةِ فَلاَ يَتَحَمَّلاَنِ شَيْئًا مِنَ الدِّيَةِ (١) . وَالتَّفْصِيل فِي (دِيَات ف ٧٦، وَعَاقِلَة ف ٣) .
