حُكْمُ الإِْذْنِ لِلْمَأْذُونِ: ٣ - الإِْذْنُ بِالتَّصَرُّفِ لِلْمَأْذُونِ جَائِزٌ عِنْدَ جُمْهُورِ الْفُقَهَاءِ إِذَا قَامَ مُبَرِّرٌ لِذَلِكَ كَالْقَاصِرِ إِذَا قَارَبَ الْبُلُوغَ فَإِنَّهُ يُؤْذَنُ لَهُ بِالتَّصَرُّفِ. وَالأَْصَحُّ عِنْدَ الشَّافِعِيَّةِ أَنَّهُ لاَ يَجُوزُ الإِْذْنُ لَهُ بِالتِّجَارَةِ، وَإِنَّمَا يَتَوَلَّى وَلِيُّهُ الْعَقْدَ (٢) .
