الْوَصِيَّةُ بِالإِْعَارَةِ: ٢٦ - ذَهَبَ جُمْهُورُ الْفُقَهَاءِ إِلَى صِحَّةِ الْوَصِيَّةِ بِالإِْعَارَةِ إِذَا خَرَجَ مُقَابِل الْمَنْفَعَةِ مِنَ الثُّلُثِ بِاعْتِبَارِهَا وَصِيَّةً بِالْمَنْفَعَةِ. وَخَالَفَ فِي ذَلِكَ ابْنُ أَبِي لَيْلَى وَابْنُ شُبْرُمَةَ (٣) .
