١٣ - وَبِالنِّسْبَةِ لآِنِيَةِ الذَّهَبِ وَالْفِضَّةِ فَإِنَّ مَنْ قَال بِجَوَازِ اقْتِنَائِهَا قَال بِالضَّمَانِ، أَمَّا مَنْ مَنَعَ اقْتِنَاءَهَا فَإِنَّهُ لاَ يُوجِبُ ضَمَانَ الصَّنْعَةِ، وَضَمِنَ مَا يُتْلِفُهُ مِنَ الْعَيْنِ. وَفِي رِوَايَةٍ عَنْ أَحْمَدَ: يَضْمَنُ الصَّنْعَةَ أَيْضًا (٢) ، عَلَى مَا هُوَ مُبَيَّنٌ فِي مُصْطَلَحِ (آنِيَة) .
