٢٤ - وَقَدْ نَصَّ الشَّافِعِيَّةُ عَلَى أَنَّ مَنْ قَطَعَ حَشِيشَ الْحَرَمِ، فَنَبَتَ مَكَانَهُ، لَمْ يَلْزَمْهُ الضَّمَانُ قَوْلاً وَاحِدًا، لأَِنَّهُ يَسْتَخْلِفُ عَادَةً، فَهُوَ كَسِنِّ الصَّبِيِّ إِذَا قَلَعَهَا فَنَبَتَ مَكَانَهَا مِثْلُهَا، بِخِلاَفِ غُصْنِ الشَّجَرِ (٢) .
