أَثَرُ الاِنْتِهَابِ: ٩ - يَمْلِكُ الْمُنْتَهِبُ مَا انْتَهَبَهُ مِمَّا أَبَاحَهُ مَالِكُهُ بِالاِنْتِهَابِ بِأَخْذِهِ، لأَِنَّهُ مُبَاحٌ، وَتُمْلَكُ الْمُبَاحَاتُ بِالْحِيَازَةِ. أَوْ هُوَ هِبَةٌ، فَيُمْلَكُ بِمَا تُمْلَكُ بِهِ الْهِبَاتُ. (٢)
