١٢٦ - وَقَدْ يَتِمُّ الْعَقْدُ مَعَ الأَْجِيرِ الْمُشْتَرَكِ بِالتَّعَاطِي - مَعَ مُرَاعَاةِ خِلاَفِ الشَّافِعِيَّةِ السَّابِقِ فِي عُقُودِ الْمُعَاطَاةِ - كَمَا فِي الرُّكُوبِ فِي سَيَّارَاتِ النَّقْل الْعَامِّ، كَمَا يَصِحُّ أَنْ يَكُونَ الْعَاقِدُ وَاحِدًا، أَوْ جَمَاعَةً كَالْحُكُومَةِ وَالْمُؤَسَّسَاتِ وَالشَّرِكَاتِ.
