جَهَالَةُ وَلِيِّ الْقَتِيل: ٤٦ - ذَهَبَ جُمْهُورُ الْفُقَهَاءِ إِلَى أَنَّ جَهَالَةَ وَلِيِّ الْقَتِيل لاَ تَمْنَعُ مِنَ الْقِصَاصِ، وَذَهَبَ الْحَنَفِيَّةُ إِلَى أَنَّهَا تَمْنَعُ مِنْهُ؛ لأَِنَّ وُجُوبَ الْقِصَاصِ وُجُوبٌ لِلاِسْتِيفَاءِ، وَالاِسْتِيفَاءُ مِنَ الْمَجْهُول مُتَعَذِّرٌ، فَتَعَذَّرَ الإِْيجَابُ لَهُ (٣) . وَتَفْصِيلُهُ فِي مُصْطَلَحِ: (قِصَاصٌ) .
