١٨٩٣ - مَسْأَلَةٌ: وَمَنْ لَزِمَتْهُ كَفَّارَةُ الظِّهَارِ لَمْ يُسْقِطْهَا عَنْهُ مَوْتُهُ، وَلَا مَوْتُهَا، وَلَا طَلَاقُهُ لَهَا، وَهِيَ مِنْ رَأْسِ مَالِهِ إنْ مَاتَ - أَوْصَى بِهَا أَوْ لَمْ يُوصِ - لِأَنَّهَا مِنْ دُيُونِ اللَّهِ عَزَّ وَجَلَّ فَهِيَ مُقَدَّمَةٌ عَلَى دُيُونِ النَّاسِ.
