"وإذا اشترك حلالات في قتل صيد الحرم فعليهما جزاء واحد" لأن الضمان يدل عن المحل لا جزاء عن الجناية فيتحد باتحاد المحل كرجلين قتلا رجلا خطأ تجب عليهما دية واحدة وعلى كل واحد منهما كفارة.
