" فَإِنْ كَانَتْ " أَيْ الزِّيَادَةُ الْمُنْفَصِلَةُ " وَلَدَ أَمَةٍ لَمْ يُمَيِّزْ " هُوَ أَوْلَى مِنْ قَوْلِهِ فَإِنْ كَانَ الْوَلَدُ صَغِيرًا " وَلَمْ يَبْذُلْ " بِمُعْجَمَةٍ " الْبَائِعُ قِيمَتَهُ بَيْعًا " مَعًا حَذَرًا مِنْ التَّفْرِيقِ الْمَمْنُوعِ مِنْهُ " وَأَخَذَ حِصَّةَ الْأُمِّ " مِنْ الثَّمَنِ فإن بذلها أخذهما
