" وَلَا إنْ أَقَّتَ " بِمُدَّةٍ كَسَنَةٍ سَوَاءٌ أَسَكَتَ أَمْ مَنَعَهُ التَّصَرُّفَ أَمْ البيع بعدها أَمْ الشِّرَاءَ لِأَنَّ الْمَتَاعَ وَالْمُدَّةَ الْمُعَيَّنَيْنِ قَدْ لَا يَرْبَحُ فِيهِمَا وَالنَّادِرُ قَدْ لَا يَجِدُهُ وَالشَّخْصُ الْمُعَيَّنُ قَدْ لَا يَتَأَتَّى مِنْ جِهَتِهِ رِبْحٌ فِي بَيْعٍ أَوْ شِرَاءٍ.
