" وَلَوْ خَلَفَ حَمْلًا يَرِثُ " لَا مَحَالَةَ بَعْدَ انْفِصَالِهِ بِأَنْ كَانَ مِنْهُ " أَوْ قَدْ يَرِثُ " بِأَنْ كَانَ مِنْ غَيْرِهِ كَحَمْلِ أَخِيهِ لِأَبِيهِ فَإِنَّهُ إنْ كَانَ ذَكَرًا وَرِثَ أَوْ أُنْثَى فَلَا " عُمِلَ بِالْيَقِينِ فِيهِ وَفِي غَيْرِهِ " قَبْلَ انْفِصَالِهِ
