" وَلَا يُثْبِتُ فِي الدِّيوَانِ مَنْ لَا يَصْلُحُ لِلْغَزْوِ " كَأَعْمَى وَزَمِنٍ وَفَاقِدِ يَدٍ وَإِنَّمَا يُثْبِتُ الرجل المسلم المكلف الحر الصالح البصير لِلْغَزْوِ فَيَجُوزُ إثْبَاتُ الْأَخْرَسِ وَالْأَصَمِّ وَالْأَعْرَجِ إنْ كَانَ فَارِسًا
