" فَإِنْ أَسْلَمَ قَبْلَهَا " أَيْ الْخِيَرَةِ " تعين من " فيمتنع القتل والإرقاق والقداء لِأَنَّهُ لَمْ يَحْصُلْ فِي يَدِ الْإِمَامِ بِالْقَهْرِ وَهَذَا أَوْلَى مِنْ قَوْلِهِ امْتَنَعَ الرِّقُّ
